These Terms of Service ("Terms") constitute a legally binding agreement between you and Trevor Heaney, operating PowerPay ("PowerPay," "we," "us," or "our"), governing your use of the PowerPay web application available at app.powerpayment.app and related services (collectively, the "Service").
You must be at least 18 years of age and reside in the United States to use PowerPay. By using the Service, you represent and warrant that you meet these requirements and that you have the legal authority to enter into this agreement.

PowerPay is a software tool only. We do not provide financial advice, investment advice, credit counseling, or any other regulated financial service. Nothing in the Service constitutes a recommendation to take any specific financial action.
Access to the full PowerPay Service requires a paid subscription at $5.99 per month ("Subscription Fee"), billed monthly on the date you subscribe.
New users may receive a free trial period as stated at signup. At the end of the trial, your payment method on file will be charged the Subscription Fee automatically unless you cancel before the trial ends.
Payments are processed by Stripe, Inc. on our behalf. By subscribing, you authorize us to charge the payment method you provide through Stripe on a recurring monthly basis. All prices are in US dollars.
We reserve the right to change the Subscription Fee. We will provide at least 30 days' advance notice of any price increase via email or in-app notification. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.
You may cancel your subscription at any time from within the app or by contacting us at support@powerpayment.app. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date. We do not provide prorated refunds for partial months.
All fees are non-refundable except as required by law or at our sole discretion. If you believe you have been charged in error, contact us within 30 days of the charge.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account at support@powerpayment.app. We are not liable for any loss resulting from unauthorized use of your account.
To use the Service, you will connect your financial accounts via Plaid. By doing so, you authorize PowerPay (through Plaid) to access your account information, including balances and transaction history, on a read-only basis. You represent that you are authorized to connect the accounts you link. You may disconnect any account at any time through the app.
If you opt in to SMS notifications, your use of that feature is governed by our SMS Terms & Conditions, which are incorporated into these Terms by reference. Standard message and data rates may apply.

All content, design, code, trademarks, and other materials in or associated with the PowerPay Service are owned by or licensed to Trevor Heaney / PowerPay. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes. No other rights are granted.
The Service integrates with third-party providers including Plaid, Stripe, Twilio, and Supabase. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party providers.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Financial data displayed in the Service may be delayed and should not be relied upon for time-sensitive financial decisions.
To the maximum extent permitted by applicable law, PowerPay and Trevor Heaney shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless PowerPay, Trevor Heaney, and our service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We reserve the right to suspend or terminate your account and access to the Service at any time for violation of these Terms, non-payment, or any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including Sections 9, 11, 12, and 13.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Travis County, Texas. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms at this URL and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
